Нови правила за събирачите на дългове, предвижда Закон за лицата, обслужващи кредити, и купувачите на кредити, който е внесен от Министерски съвет в парламента.
Той предвижда задължение купувачът на кредити и лицето, обслужващо кредити, да изпълняват задълженията си добросъвестно и професионално, като третират справедливо кредитополучателите, зачитайки техните права и интереси.
За целта информацията, която предоставят на длъжника трябва да бъде ясна, разбираема и коректна. Забранява се предоставянето на заблуждаваща информация.
Забранява се събирачите на дългове да звънят по телефона на длъжниците в периода от 20:00 до 7:00 часа, както и в почивни и празнични дни. Те няма да имат право да осъществяват контакт във връзка с или по повод на вземането с лица, срещу които вземането не е прехвърлено.
Фирмите за събиране на кредити няма да имат право да поставят уведомления и информация за дълга на потребителя под всякаква форма на обществени места.
Забранява се прилагането на агресия по смисъла на Закона за защита на потребителите.
Предвидени са и санкции, като за лице, обслужващо кредити, което не осигури справедливо и етично третиране на кредитополучателите, които не са потребители, се наказва с имуществена санкция в размер от 20 000 до 40 000 лв., а при повторно нарушение – от 40 000 до 80 000 лв.
В Закона за частните съдебни изпълнители пък е записано, че частният съдебен изпълнител осъществява комуникация с кредитополучателите единствено по телефона или с писма на хартия или по електронната поща, адресирани лично до длъжника. По своя инициатива длъжникът може да посети кантората на частния съдебен изпълнител. Информацията, предназначена за кредитополучателите, трябва да е ясна, разбираема, коректна и да не въвежда в заблуждение.
При получаване на плащане, частният съдебен изпълнител ще е длъжен да предостави на длъжника справка за полученото плащане и остатъка от задължението или писмо за освобождаване от задължението. Информацията се предоставя на хартиен или друг траен носител.
